Under its deportation provisions, a noncitizen already in the United States could be removed if they engage in advocacy for socialism, communism, Marxism or Islamic fundamentalism, distribute or publish material promoting those ideologies or hold membership in affiliated organizations at any point after admission.

It does encroach, but they’ll still go for the ban.

It’s my understanding that the first amendment (and presumably others) doesn’t apply to non-citizens who are outside the US.
well considering they already asked me these questions when I applied for my residency and my green card and will again if I become a citizen I doubt it
This might be a silly question but as a non-citizen do you have 1st amendment rights? I feel like you should but college students critical of Israel are being kidnapped by the government so idek at this point.

No, it doesn’t. The US currently bans all communists from applying to be citizens or have long term visas. That has been held as constitutional for pretty much 80 years.
Since the US allowed that discrimination in place without any popular uprising, this new restriction would entirely be allowed and encouraged by the American public.
They can prevent new immigration, yes, but even foreign nationals in the US are afforded bill of rights protections.
