All of the major sports leagues have this exemption. The concept of the league doesn’t work if the exemption doesn’t exist and there is significant economic turbulence in the industry as a result during the competitive period (see: AFL and NFL history as well as the absorption of the ABA by the NBA).
This coupled with these exemptions not implicating essential industries or services means it’s an easy decision to make with near-zero downside.
Two decades ago, 9 out of 10 of the top research institutions on the planet were in the US. Today, it’s only 1 out of 10 (Harvard).
You know what did change in the meantime? College sports! There’s even more now — with gambling, too.
Commodified sports have parasitized Universities across the US — our repositories of knowledge and pillars of human civilization are catering to drunk sports fans for money and 40% of the student body at Stanford is just legacies and athletes.
The NCAA should be illegal. Profiting from sports affiliated with colleges should be illegal. Disgusting capitalists and sports fans weren’t satisfied with the NFL you had to infect universities as well with this bullshit.
I don’t know what to say to you if you think that college sports have become more or less commotized in the last two decades.
Division 1 NCAA athletic departments are:
- Net contributors to their school’s general fund;
- Self-funded and firewalled from accessing the general fund; and
- The largest single factor in quality off applicants— the median SAT score of an applicant significantly increases in years following success in football or men’s basketball.
Honestly, I’m surprised that you’re not self aware enough to not comment on a topic on which you’re completely uniformed.
I work in academia and just watched again someone scoring a 23 on the ACT gain admission to one of the most “prestigious” institutions on the planet TO PLAY SPORTS. A spot that could have gone to one of the countless deserving students who have dedicated their lives to science, philosophy, or art, was stolen by someone with ZERO interest in education.
Stanford is rich. It has tens of billions of dollars. It would have no issues funding itself for the next century. I’m not exaggerating. Also, no other country’s higher education works this way. Can you imagine Oxford raising money by recruiting professional athletes instead of academics? Fucking grotesque.
So yes, a school can use televised athletics to fund education, just as a church can raise money by opening a brothel. The point is that this is destructive of the underlying institution and its values.
If you wanna watch sports do it. Why parasitize our educational institutions? Why not just do it independently like every other nation on earth? Because in America the WWE is in charge of the department of education.

Most people don’t realize that the official teams were created to give the working class a controlled “battle” to fight and a “hometown army” to belong to, both controlled by the wealthy, so the working class wouldn’t form one on their own.
You know what the ruling class definitely doesn’t want? A bunch of tough stickball players and the crowd at the game, storming the governor’s house after a match because they spent the whole night before talking about how low wages are and how they should do something. Then, got drunk on the empowerment of their sunday winning game and decided to actually do something while everyone was together, well fed, feeling strong and important.
The same reason they do goddamn anything. They’re getting their pockets lined.
